Ok so I might be a bit of a whiner but - I was looking at the pins for "Jessica" Rabbits 20th Anniversary, lol and I noticed one of the pins is taken
directly from a Fan Art bumper sticker that's been around for a while now. It may seem trivial, but in a way - we're paying good money for these pins
that are created by the whole pin development team there, yet they are kind of stealing fan art as their own ideas. It's a little different but you can see
where its taken. What do you think about this? Here is the pic below to compare.

They are definitely similiar but Disney made her look ALOT better.
I think it is an incredible looking pin! As for where the Art originated it has, in my opinion, gone full circle... Disney drew it... someone did a pic based on Disney's art... Disney reworked what already was taken from them. No harm no foul! |

Actually, Shell, I'm going to have to disagree with you.
I see this ALL the TIME in my various fandoms (I run in convention circuits a lot, and my degree is in Animation and Motion Picture Technology), and it never fails to disgust me. Comic Book artists are usually the worst about it, but now, I see someone slipped into the pin design team who can't create without stealing. ...it actually really ticks me off. Plagerism, even if the work is based off a copyrighted character or work, is still so low...

As a side note I don't see why the fanart is specifically Jessica... it could be any buxom woman. Kind of reminds me of all the bootleg Jessica pins out
there that don't have anything to do with her character except have red hair and a large chest.

::jaw drops:: Wow... I...really don't know what to say. Mike- look at her from the waist down in both images. The artist for the pin drew it EXACTLY the same, except for some folds in the clothes. The head and bust is mostly re-done, but the artist still took the overall concept and half the pose. If this was anything but fanart and this was taken to a court of law, the judge would have no problems seeing that it was a stolen piece. And just because the fanartist might not have a legal recourse, it doesn't make the plagerism any less wrong. Jes- I'm not sure how you can look at that and not think it's Jessica. Even though Jessica's face has the fanartist's original touch, it still looks like her. $$#%, her face changes frequently for Disney merchandise and even in the movie. I think this piece is much nicer than the crapily drawn fantasy pins out there... JACanepa- Were you thinking about reporting this to Disney? Because if you don't, I will. I have no tolerance for this type of low-brow artist. Or maybe I should just go ahead and do it, since two people will make more of an impact than one... |

I guess I focus more on faces... from the waist down most shapely cartoon women in heels look similar.
The fan-artist drew a picture if a character he or she had no right to use, and then in some way distributed or allowed the image to be distributed publicly. He or she has no right to the image or to complain if Disney chose to make art using a similar pose. As for the pin artist, since the Jessica fans seem to like the pose, why wouldn't you use it? Jes "Simply Mad"

The piece of art from that was a still-frame from the movie (or a promo piece done for it, yes)? Anyway, there's no art being ripped off here (and Disney's part, anyway)...just the pin idea. The art was already there. Yeah, it's still kind of fishy. But in this case, Chinese bootleggers went about stealing Disney's art in the first place, re-tooled it for their profits, then released a pin to make money off their character. All Disney did in this case was say "Hey...that pose is a good idea for a pin", and yoinked it back. They might have even released it on purpose to bring some of that bootleg profit back around to them and make people aware that a bootleg version even existed...that way, there was an official basis of comparison. Hard to say. Regardless, not really the same issue as above, although interesting in the sense of how Disney's strategies work... |
